So what Argo is saying is that if the tank oil runs by the check valve over time and the dipstick shows little to no oil level, that there is still enough oil in the tank to prevent oil starvation on startup? (With the proper oil level initially).

Ok for the record I will come clean on my wet sumping issue. When I was chasing this problem, the engine would smoke excessively at start up and then eventually clear up. Next time I started it the same issue was there. So I went through the process of changing oil pumps, oil seals, polishing the shuttle valve barrel,and polishing the seat surface. Even after all of these improvements the problem returned.
After Argo confirmed to me that some oil does flow through the scavenger pump,I quit chasing this problem. Some time later after running up this engine and clearing up the smoke, I pulled the spark plugs to inspect them.
This is when I saw some smoke coming out of the plug hole and smelt some oil burning on top of the pistons. I had previously removed the head twice and installed new valve seals on both occasions. I found a parts fiche and confirmed that there were Viton o'rings installed under the valve guides. At that point I suspected someone had previously upgraded the exhaust guides without installing the required o'rings. After removal of the head and the guides it confirmed the smoke issue was indeed caused by the dripping of oil through the guides due to different expansion rates of the steel and aluminium.
Upon firing up the engine after o'ring installation the smoke issue was eliminated. So what I thought was an issue of wet sumping was an issue of oil dripping past the exhaust valves. I still believe it wet sumps but smoke is not an issue.

In addition to all the other comments on the wet sumping issue, obviously Argo's comments regarding the amount of oil that will drain from the tank have been taken on board by me and my bike seems to be as he suggests(that is the tank does not drain completely)so good news, my bike is still running with the valve the "wrong" way round and still partially drains the tank, as it is it seems fine so until time allows I will leave it alone., In addition regarding oil Argo suggests using synthetic oil, I commented that I have had issues with clutch slip, This difference of opinion was sadly created as I had not realised Argo meant to use Motorcycle specific synthetic, where I had used car engine synthetic - silly me !!!,bearing in mind above comments my bike has never suffered smoking at any time so I had not had smoking/wet sumping issues. Question, If I have my left side engine covers off (inner and outer), should the oil tank be able to drain fully? I read earlier on this thread that the scavenge pump lets some oil come back but it shouldnt be the entire capacity of the oil tank right? Otherwise it would be a wet sump setup, so do I just need to replace the seals on the oil pump or mess with that valve you guys were talking about earlier?
I guess what I am asking is what is more likely to have failed?
I pulled the cover and a bunch of oil came out and it looks like there is nothing on the oil level dipstick. It hasnt run yet in my possession so I know its not consumption, and I literally just changed the oil.
My other question is, if the entire contents of the oil tank are emptying into the engine, is the only thing i have to worry about - dry starting the top end? Because Im not going to worry about it as long as it doesnt leak out of the engine or cause engine damage.

Nevermind, it was just the seal for the cover. Also had oil pressure tested on my revised 1st gen engine and it was roughly 50psi cold
